Publication of CP8 Common Communication

The CP8 Common Practice on ‘Use of a mark in a form differing from the one registered’ was adopted by the Management Board by written procedure in May 2020, following official acknowledgement sent by all IPOs in April 2020. It delivers a set of principles and examples on the use of a trade mark in a form differing from the one registered by taking into account the impact of additions, omissions, and modifications of characteristics on the distinctive character of registered word marks, purely figurative marks and composite marks (combination of verbal and figurative elements).

The Common Communication document, which includes the CP8 Common Practice and complementary information, such as the implementation dates for each implementing office was published simultaneously on the websites of the IP offices of the European Union on 15 October 2020. The CP8 Common Practice is the result of consultations and contributions submitted by stakeholders over the past two years as well as the fruitful collaboration of the Working Group, composed of experts from national and regional IP offices of the EU and users associations.
